Forced Conservatorship Tops Elder Abuse And Financial Exploitation Red Flag List

In 2009, the Portland professional guardianship firm of Tiffany-O’Shea was appointed conservator for Thelma Brock. Now Thelma’s former daughter-in-law Penny Brock is challenging both the intitial need for the conservatorship, as well as its management under state and federal laws and procedures.

In addition to objecting to the appointment of any conservator, she specifically objected to Tiffany-O-Shea. It seems very revealing that the investigator left two boxes blank on her form - the ones which gave Thelma the right to waive her right to a hearing.

Richard Pagnano argued Thelma lacked the ability to manage her own affairs, yet continued to bill the estate after leaving Thelma in in pro per status without an attorney. In addition to not notifying me of the conservatorship, Mr. Pagnano and lawyers from Prestige Care, Inc. and Portland Court Bonds are in my opinion, based on allegations on file with the court, working together to thwart a full and fair investigation.”
In addition to forcing a conservatorship on Thelma Brock, Penny is concerned about another red flag commonly seen by experts - the isolation of family members and pitting them against each other.
“They did this with my husband and his mother,” Penny said, “and I still see the same pattern today. I believe this is being done by the behind-the-scene lawyers who really call the shots in elder abuse cases to protect the financial interests of the corporations and insurance companies they represent”.
